Sulzer Mixpac klaagt namaker F-system-inktpatronen aan en behaalt grote juridische overwinning
HAAG, Zwitserland & SHANGHAI–(BUSINESS WIRE)– Sulzer Mixpac Ltd. (Sulzer) heeft vandaag bekendgemaakt dat het juridische stappen heeft gezet om zijn producten te beschermen tegen namaak in China. Op 17 augustus 2015 diende Sulzer bij de rechtbank voor intellectueel eigendom in Ghuangzhou een aanklacht in tegen Dongguan Cohui Industry Material Co., Ltd. uit de provincie Guangdong wegens schendingen van Sulzers patentrechten door nagemaakte F-system-inktpatronen van Sulzer aan te bieden. Op 18 augustus 2016 oordeelde de rechtbank van Guangzhou in het voordeel van Sulzer en werd Cohui bevolen de producten niet langer te produceren, te verkopen of te koop aan te bieden. Daarnaast beval de rechtbank Cohui Sulzer een schadevergoeding te betalen voor de inbreuk. Op 10 oktober 2016 tekende Cohui beroep aan bij het Hof van Guangdong. Op 21 april 2017 velde het Hof van Guangdong een definitief oordeel uit over de zaak en vaardigde een permanent dwangbevel tegen Cohui. Het Hof kwam ook tot een definitieve schadevergoeding die Cohui moet betalen. Het permanente dwangbevel verbiedt Cohou de cartridges te promoten, verkopen of te koop aan te bieden in China.

HAAG, Switzerland & SHANGHAI–(BUSINESS WIRE)– Sulzer Mixpac Ltd. (Sulzer) announced today that it has taken further legal actions to protect its products from copying in China. On August 17, 2015 Sulzer filed a lawsuit in the Guangzhou IP Court in China alleging that Dongguan Cohui Industry Material Co., Ltd. of Guangdong Province, China (Cohui) infringed Sulzer’s patent rights by offering copies of Sulzer’s F-system cartridges. On August 18, 2016 the Guangzhou IP Court rendered a judgment in favor of Sulzer, and Cohui was ordered to stop the manufacture, sale and offer for sale of the infringing products and ordering Cohui to pay damages to Sulzer for the infringement. On October 10, 2016 Cohui filed an appeal to the Guangdong Higher Court, the appellate court of the Guangzhou IP Court. On April 21, 2017, the Guangdong Higher Court rendered a final decision in the matter awarding Sulzer a permanent injunction against Cohui and a final damage award against Cohui.
