GSMA becommentarieert de overeenkomst over Europese code voor elektronische communicatie

Europa laat kansen liggen om 5G-leiderschap te tonen
De Europese Commissie, het Parlement en de Raad hebben een politiek akkoord bereikt over de Europese code voor elektronische communicatie (EECC). Naar de mening van de GSMA is deze overeenkomst een politiek compromis dat er niet in slaagt de uitdagingen op lange termijn voor de Europese telecommunicatiesector het hoofd te bieden en dat de ontplooiing van 5G-netwerken in Europa kan belemmeren, waardoor het concurrentievermogen van de regio wordt verzwakt en de Europese burgers schade wordt berokkend.
Deze tegenslagen omvatten in het bijzonder:
- Onzekerheid over investeringen: de GSMA is teleurgesteld dat de overeenkomst niet voldoende beantwoordt aan de ambitie om de regelgeving ingrijpend te hervormen, wat investeringen ten goede komt. De GSMA is van mening dat alleen een dergelijke garantie de industrie in staat zou stellen de nodige investeringen te doen die uiteindelijk ten goede zouden komen aan de consumenten.
- Gebrek aan harmonisatie: hoewel er enkele constructieve bepalingen zijn ingevoerd, blijven de belangrijkste kwesties onaangetast. Dit houdt onder meer in dat moet worden gezorgd voor een zinvolle convergentie van spectrumaangiften in de lidstaten en dat beleggers moeten worden gerustgesteld dat vergunningen een langere looptijd zullen hebben dan nu het geval is.
- Gebrek aan een ‘level playing field’: ondanks enige vooruitgang wordt in de overeenkomst geen aandacht besteed aan het feit dat de Europese telecomsector nog steeds overgereguleerd is, op sommige belangrijke gebieden, waardoor hij niet profiteert van gelijke concurrentievoorwaarden. De overeenkomst brengt een aantal consumentenrechten die verbonden zijn aan het gebruik van alle aanbieders van interpersoonlijke diensten op één lijn, maar er blijven nog veel verschillen bestaan. Een beleid van “dezelfde dienst, dezelfde regels” zou leiden tot meer concurrentie, innovatie en voordelen voor de consument.
- Aanvullende prijsregulering: Voor de eindgebruiker zijn de vastgestelde maatregelen voor gesprekken binnen de EU niet gerechtvaardigd, aangezien consumenten en bedrijven uiteenlopende keuzemogelijkheden hebben om naar andere EU-landen te bellen. Bovendien is de overeenkomst in strijd met het EU-recht, met name met de in het Verdrag betreffende de Europese Unie verankerde beginselen van subsidiariteit en evenredigheid.

Europe Passes Up Opportunity To Demonstrate 5G Leadership
The European Commission, Parliament and Council have reached a political agreement on the European Electronic Communications Code (EECC). In the GSMA’s view, this agreement is a political compromise that fails to confront long term challenges for the European telecommunication sector and could hinder deployment of 5G networks in Europe, weakening the region’s competitiveness and harming European citizens.
In particular, these setbacks include:
- Investment uncertainty: the GSMA is disappointed that the agreement does not deliver sufficiently on the ambition to provide a strong, pro-investment regulatory reform. The GSMA believes that only such an assurance would allow the industry to make the necessary investments that would ultimately benefit consumers.
- Lack of harmonisation: while some constructive provisions have been introduced, the main issues remain untouched. These include ensuring meaningful convergence of spectrum awards across the Member States, and reassuring investors that licenses will have a longer duration than today.
- Lack of a level playing field: despite some progress, the agreement fails to address the fact that the European telecoms sector is still over-regulated, in some key areas, resulting in it not benefitting from a level-playing field. The agreement does align some consumer rights attached to the use of all interpersonal services providers, but many differences still remain. A policy of ‘same service, same rules’ would lead to more competition, innovation and consumer benefit.
- Additional retail price regulation the adopted measures on intra-EU calls are unjustified, as consumers and businesses enjoy a variety of choices for making calls to other EU countries. Moreover, the agreement infringes EU law, notably the principles of subsidiarity and proportionality enshrined in the Treaty on the European Union.
